These Terms of Service ("Terms") govern your access to and use of the MyWiggles platform operated by MyWiggles LLC, a South Carolina limited liability company ("MyWiggles," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
MyWiggles provides a software-as-a-service platform that allows dog breeders and rescue shelters ("Breeders") to create and manage a public-facing website, list available puppies, manage health records, communicate with prospective buyers, and accept subscription payments. The platform is available at mywiggles.com and through Breeder-specific subdomains. The platform also provides free Buyer accounts that allow prospective buyers to communicate directly with Breeders through the MyWiggles chat system.
You must be at least 16 years old to create any account on MyWiggles, whether as a Breeder or a Buyer. By registering, you represent that:
We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, pose a risk to the platform or its users.
MyWiggles offers a 30-day free trial for Breeder accounts. After the trial period, continued use requires a paid subscription at the then-current price (currently $25.00/month USD). Subscriptions are billed monthly in advance through Stripe, Inc. Buyer accounts are free.
You agree not to use the Service to:
We reserve the right to remove any content that violates these Terms and to suspend accounts accordingly.
You retain ownership of all content you upload to MyWiggles (dog profiles, photos, litter records, etc.). By uploading content, you grant MyWiggles a limited, non-exclusive license to store, display, and deliver that content as necessary to operate the Service.
You are solely responsible for ensuring your content is accurate, lawful, and does not infringe the rights of others. You represent that you have the right to use and publish all photos and information you upload.
We aim to provide reliable uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance, make updates, or temporarily suspend access for operational reasons. We will make reasonable efforts to notify you in advance of significant downtime.
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
By using the MyWiggles chat system, you acknowledge and agree that:
Breeders may request deletion of their account at any time through the "Delete Account" feature in their dashboard. Upon deletion, all associated data — including dog records, photos, contact messages, chat conversations, and waitlists — will be permanently erased on the scheduled deletion date. This action cannot be undone.
Buyers may request deletion of their account by contacting us at admin@mywiggles.com.
We may terminate any account for violations of these Terms, with or without notice. In the event of termination for cause, Breeders are not entitled to a refund of any prepaid subscription fees.
To the fullest extent permitted by applicable law, MyWiggles LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the total amount you paid us in the 3 months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
These Terms are governed by the laws of the State of South Carolina, USA, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of South Carolina.
We may update these Terms from time to time. When we make material changes, we will notify active Breeders by requiring acknowledgment on their next login. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
